Probably one glass of wine too many prior to posting.....but the whole compensation culture" in this country gets my blood boiling.I absolutely agree that there's no excuse for poor driving - and there are many people out there who should have their driving licences revoked. Maybe the driving licence should be subject to a three year retest or something.Mind you - there's also quite a few dangerous cyclists out there too.....Any kind of dangerous road use should be properly punished."

    Similar thing happened to me last week, I called the Police and gave the reg number, the response was that they'll try and trace the guy to get his insurance details but won't take it any further since I wasn't injured. I'm not looking for compo or anything else other than the driver paying for the repairs and replacement parts he is responsible for. Wouldn't mind so much if I hadn't been lit up like a christmas tree and wearing high viz clothing...one question that did irritate me from the Police was whether I was wearing a helmet. I was wearing a helmet but since it isn't a legal requirement and not relevant to the incident I fail to see the importance of it, yet the way the question was asked that was the one they seemed interested in.

    I sit firmly on the fence when it comes to compensation... certainly I think wild claims for 'psychological damage' and similar are below the belt in this type of incident, however I fail to see why someone should be out of pocket due to another persons negligence?'d always claim damages if I was not to blame, but unless I was messed up, thats where I'd leave it. I think as mentioned and highlghted above, I'd be happier to walk away with no damages if the police would take more action against these drivers... why is it a case of 'no harm no foul' when actually what we are witness to here is a demonstration of a lack in basic competence, which if unaddressed could lead to a death next time out.... certainly it is more likely to lead to a death if a negligent driver gets the affirmation of their skills by the polices lack of interest. But there you go.

    Hi folks, this is my first post on this forum.Today I was hit by a cage driver who decided he wanted to turn into a side road by going through me, I'm not particularly hurt as i kept hold of the cars bonnet to save a trip to the tarmac but no doubt I'll ache like hell tomorrow!Anyway I'm not into the where there's blame there's a claim" culture but I do want/expect my bike replacing if I was in my car my car insurance would claim for my repairs but how does it work for a cyclist? I say replacing as pending an inspection I hope to get done tomorrow I think my Bianchi is dead! Does anyone have any advice how I proceed.I have details for the driver, witnesses and contacted the police by phone earlier and will be paying a visit to the station first thing.Any advice would be greatly received"

    If you don't want to claim injuries best bet is calling the other persons insurers direct.

    Bump, Bump. I should hope the OP's problem is sorted 4 months on!! Actually I liked adm's post best, didn't read it first time out, sounds like he was in as bad a mood as I am today!

    Hi 3 months ago I was cycling home on my twenty mile return commute, as I approached a junction, a car never stopped at the junction and wiped me out, high vis night vision jacket lights on front and back of helmet, 3 lights on front 3 on back of bike and light on back of high vis jacket, and he said he heard me but never seen me hmmmm, as a result I suffered a broken wrist, broken toe, whiplash, neck damage, knee tissue damage, bruising to left calf, I was in plaster 9weekshad 6 hospital and doctor visits, a MRI scan, and been off work 12 weeks, still not able to get back on bike, a phone call from police on answer phone told me they had strong words with the driver, really angry about this,and are thinking of getting back on to the police to express my disgust, any thoughts on this guys thanks

    My sympathies Jazzer it's not a pleasant experience trying to recovery fully from being hit with a lethal weapon. I suffered a similar fate recently luckily the police charged the driver with careless driving in my case. I don't know why in some cases they charge the driver and in others they don't for the same type of accident.
